4. Intellectual Property
4.1 The website and all its contents, including but not limited to text, graphics, logos, images, and software, are the property of realreviews.io or its licensors and are protected by intellectual property laws.
4.2 You may not reproduce, distribute, modify, or transmit any content from the website without prior written permission from realreviews.io.
5. Disclaimer of Warranties
5.1 The website and its services are provided on an "as is" and "as available" basis without any warranties, expressed or implied.
5.2 Realreviews.io does not guarantee the accuracy, completeness, or reliability of any content or information provided on the website.
5.3 Realreviews.io disclaims any liability for any damages or losses arising from the use of or reliance on the website or its contents.
6. Limitation of Liability
6.1 To the maximum extent permitted by law, realreviews.io shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use the website or its services.
6.2 Realreviews.io shall not be liable for any errors, omissions, interruptions, or delays in the website or its services.
7. Suspicion of Fraudulent or Phishing Activity
If we (RealReviews) have reasonable grounds to believe that a business-profile or brand page is used for phishing, fraud, misrepresentation, or any other unauthorized or malicious activity, we reserve the right to suspend and/or permanently delete the relevant page immediately, without prior notice.
8. Modifications to Terms
Realreviews.io reserves the right to modify these Terms at any time without prior notice. It is your responsibility to review these Terms periodically to stay updated with any changes.
9. Good-Faith Content Moderation
9.1 RealReviews.io may, but is not required to, monitor, review, or moderate content submitted by users.
9.2 We may take any action we consider appropriate with respect to user content or accounts — including, without limitation, screening, holding, reformatting, flagging, hiding, removing, refusing to publish, restricting, suspending, or terminating — using automated systems (including AI-based fake-review detection, sentiment classification, language detection, and content-compliance screening), human moderators, or any combination of them.
9.3 Moderation decisions are made on the basis of signals our automated systems and our human moderators consider relevant in good faith, some of which may later prove inaccurate. We do not warrant the accuracy, completeness, or correctness of any moderation decision.
9.4 To the maximum extent permitted by applicable law, RealReviews.io shall have no liability for any moderation decision taken in good faith, including (a) any decision to remove, hide, restrict, or refuse to publish content we consider objectionable in our sole discretion, whether or not such content is in fact unlawful or in violation of these Terms, and (b) any decision not to remove, hide, or restrict content that a user, business, or other third party has reported.
9.5 The procedures, response targets, and appeal timelines published in our Editorial Policy and Feedback & Complaints Policy are operational goals, not contractual commitments, and nothing in those policies waives or limits this section 9.
10. Indemnification by Users
10.1 You agree to defend, indemnify, and hold harmless RealReviews.io and Next Planet Corp., and their respective officers, directors, employees, agents, and affiliates, from and against any and all claims, demands, actions, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) any content you submit to or through the website; (b) your use of, or activities on, the website; (c) your breach of these Terms, or of any representation or warranty you make under these Terms; or (d) your violation of any third-party right, including any right of publicity, privacy, or intellectual property.
10.2 We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to your indemnification, in which case you agree to cooperate with our defense of those claims.
10.3 This section 10 survives termination of these Terms.
11. Copyright Complaints (DMCA)
11.1 RealReviews.io respects the intellectual-property rights of others and complies with the U.S. Digital Millennium Copyright Act ("DMCA").
11.2 If you believe content on the website infringes your copyright, please send a written notice to our designated DMCA agent at contact@realreviews.io (subject line: "DMCA notice") including all of the following:
- a physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf;
- identification of the copyrighted work claimed to be infringed;
- identification of the material claimed to be infringing, with sufficient detail to locate it on the website;
- your contact information (name, address, telephone number, and email);
- a statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;
- a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.
11.3 We may, in our sole discretion and in appropriate circumstances, terminate the accounts of users we identify as repeat infringers.
12. Governing Law, Dispute Resolution, and Limitations
12.1 These Terms, and any dispute arising out of or in connection with them, are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles, except where the mandatory consumer-protection law of your country of residence provides otherwise.
12.2 Subject to 12.3, any action arising out of or relating to these Terms or to the website shall be brought exclusively in the state or federal courts located in the State of Delaware, and you irrevocably consent to the personal jurisdiction of those courts.
12.3 If you are a consumer resident in the European Union or in another jurisdiction whose mandatory law gives you the right to bring proceedings in your home jurisdiction or to have local law applied, nothing in 12.1 or 12.2 limits those mandatory rights.
12.4 Subject to mandatory rights under applicable law, and notwithstanding any other provision of these Terms, the total aggregate liability of RealReviews.io and Next Planet Corp. to you for all claims arising out of or relating to these Terms or your use of the website is limited to the greater of (a) one hundred U.S. dollars (USD 100) or (b) the total amount you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim. This cap applies regardless of the form of the action, whether in contract, tort, statute, or otherwise.
12.5 EU consumers may also access the European Commission's online dispute-resolution platform at ec.europa.eu/consumers/odr.
13. Intermediary Status
13.1 The website is an online platform that publishes user-generated reviews and other content. RealReviews.io is not the author of any user-generated content and does not adopt, endorse, verify, or assume responsibility for it.
13.2 To the maximum extent permitted by applicable law — including 47 U.S.C. § 230 in the United States and Articles 4 to 6 of Regulation (EU) 2022/2065 (the EU Digital Services Act) in the European Union — RealReviews.io acts as an intermediary host of user-generated content and is not treated as the publisher or speaker of that content. Our voluntary moderation of content under these Terms or under our Editorial Policy and Feedback & Complaints Policy does not waive this status.
14. General Provisions
14.1 Severability. If any provision of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
14.2 No waiver. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
14.3 Entire agreement. These Terms, together with our Privacy Policy, Cookie Policy, Editorial Policy, Feedback & Complaints Policy, and Ownership & Funding page, constitute the entire agreement between you and RealReviews.io with respect to the website, and supersede any prior agreements between you and RealReviews.io on the same subject matter.
14.4 Survival. The provisions of sections 3 (User-Generated Content licence), 5 (Disclaimer of Warranties), 6 (Limitation of Liability), 9 (Good-Faith Content Moderation), 10 (Indemnification), 12 (Governing Law and Limitations), and 13 (Intermediary Status) survive any termination of these Terms or of your use of the website.
14.5 Acknowledgment. By using realreviews.io, you acknowledge that you have read, understood, and agreed to these Terms and Conditions of Use.
